1 ACKNOWLEDGEMENT
The renter expressly acknowledges the general rental conditions as an integral part of the rental agreement, especially the liability for damages caused by the renter to the rental object or third-party property, and ensures that they are properly informed about the handling of the rental object. Carrying animals on the rental objects is prohibited.

 

2 BEGINNING AND END OF RENTAL
All rentals begin at the domicile of the lessor and end as soon as the rental object is returned on time to the domicile of the lessor. In case of inability to start the rental or unexpected extension, the lessor must be immediately informed. If the rental object is not returned after the agreed time, the renter must pay CHF 200.– for each hour or part thereof.

 

3. CANCELLATION CONDITIONS

If the renter wishes to cancel a booking or reservation, the following cancellation conditions apply depending on the booked or reserved product:

 

3.1 CANCELLATION AND RESCHEDULING CONDITIONS PEDALO LARGE

  • Up to 48h before rental start, the full amount will be refunded, minus a cancellation fee of CHF 10.00.
  • For cancellations less than 48h before rental start, the full amount must be paid, and there will be no refund.
  • Any cancellation insurance is the responsibility of the customer and is recommended. 
  • Instead of a cancellation, bookings can be postponed by arrangement with us. Please contact us by email (mail@bootsvermietungenge.ch) with the indication of the new desired and available date and time. A fee of CHF 20.00 per boat will be charged for last-minute postponements less than 48 hours before the start of the rental period. 
  • Due to weather conditions, it may be necessary for Boat Rental Enge to cancel bookings, e.g., in case of heavy rain and/or storm warning.

3.2 CANCELLATION AND RESCHEDULING CONDITIONS ELECTRIC BOATS SHORTBREAK 5.8

  • Up to 48h before rental start, the full amount will be refunded, minus a cancellation fee of CHF 20.00.
  • For cancellations less than 48h before rental start, the full amount must be paid, and there will be no refund.
  • Any cancellation insurance is the responsibility of the customer and is recommended. 
  • Instead of a cancellation, bookings can be postponed by arrangement with us. Please contact us by email (mail@bootsvermietungenge.ch) with the indication of the new desired and available date and time. A fee of CHF 30.00 per boat will be charged for last-minute postponements less than 48 hours before the start of the rental period. 
  • Due to weather conditions, it may be necessary for Boat Rental Enge to cancel bookings, e.g., in case of heavy rain and/or storm warning.

3.3 CANCELLATION AND RESCHEDULING CONDITIONS SAUNA BOATS “Hildi” + “Alice“

  • Up to 7 days before rental start, the full amount will be refunded, minus a cancellation fee of CHF 30.00.
  • For cancellations between 7 days and 48h before the start of the rental, half or 50% of the paid amount will be refunded.
  • For cancellations less than 48h before rental start, the full amount must be paid, and there will be no refund.
  • Any cancellation insurance is the responsibility of the customer and is recommended. 
  • Instead of a cancellation, bookings can also be postponed. Please contact us by email (mail@bootsvermietungenge.ch) with the indication of the new desired and available date and time. A postponement fee of CHF 30.00 per boat will be charged if the booking is postponed between 7 days and 48 hours before the start of the rental period. A fee of CHF 80.00 per boat will be charged for last-minute postponements less than 48 hours before the start of the rental period. No postponements are possible less than 6 hours before the start of the rental period. 
  • Due to weather conditions, it may be necessary for Boat Rental Enge to cancel bookings, especially in case of a storm warning.

3.4 CANCELLATION CONDITIONS ZAR 59 SL, YAMARIN 63 DC, OVATION 6.8

  • Reservations can be canceled free of charge up to 48h before rental start.
  • For cancellations less than 48h before rental start, the full amount of the reserved period must be paid.
  • Any cancellation insurance is the responsibility of the customer and is recommended.
  • Due to weather conditions, it may be necessary for Boat Rental Enge to cancel reservations, especially in case of a storm warning.

3.5 CANCELLATION CONDITIONS ZÜRIFÄSCHT 2023

  • The bookings take place in all weather conditions, even in rain, and cannot be canceled by the customer.
  • Any cancellation insurance is the responsibility of the customer and is recommended.
  • Refunds are only possible in case of cancellation of a fireworks display or storm warning and are then based on the time of the event and the possibly already used rental duration.

4 AUTHORIZATION TO OPERATE THE RENTAL OBJECT
Only the person who has signed the rental contract is authorized to maneuver the boat. The renter is fully liable for any traffic violations, etc. If the rental object is not anchored, the renter must always be ready to maneuver. The renter must be of legal age. Children and adolescents are under the responsibility of their parents/guardians.

 

5 RENTAL BOAT
The rental boat is provided in a ready-to-use condition. The renter/driver commits to taking care of the rental object.

 

6 DUTIES IN CASE OF ACCIDENT
The renter is responsible for immediately notifying the landlord and the water police, as well as for making an accident sketch and for recording the names and addresses of the persons involved in the accident and witnesses. Oral or written promises to third parties regarding services to injured parties should be avoided and are irrelevant for the lessor.

 

7 LIABILITY-FULL INSURANCE
In the event of damage, the renter has to pay a minimum of CHF 500.- as deductible and compensation. The renter/driver remains personally liable for all damages not covered by liability and comprehensive insurance. The landlord declines any responsibility and consequential costs in case of personal injury. The users and guests of the rental boats are responsible for their own accident/personal protection insurance.

 

8 DAMAGE TO THE RENTAL BOAT
The renter/driver is liable for any damage with a contribution of at least CHF 500.– (deposit) as compensation and deductible. In case of gross negligence, not covered by insurance, the renter is fully liable for the entire damage.

 

9 REPAIRS
The renter is obligated to inspect the rental object before the start of the rental period. If there is no objection, it will be assumed that the rental object is in good condition at the time of handover. The renter is liable for any damages occurring during the rental period, as described in points 6 and 7. Necessary repairs must generally be carried out by a workshop designated by the lessor. Repairs or modifications to the rental object may not be made without the lessor’s consent. During the duration of a repair, the renter shall pay the lessor a daily compensation equivalent to the evening rental rate for the operational downtime.

 

10 LESSOR LIABILITY
The rental company is not liable for any damages that may occur to the renter due to a defect in the rental object that prevents further travel, causes time loss, or other consequential damages.

 

11 FULFILLMENT OF CONTRACT
In the event that the rental object cannot be made ready to drive between the conclusion of the contract and the start of the rental period, the rental company has the right to withdraw from the contract without any compensation.

 

12 LOSS OF PROPERTY
In the event of loss of the rental company’s property (keys, rain scoop, etc.), a compensation of 200.– will be charged. The rental company is not liable for property left behind by the renter.

 

13 SUPPLEMENTARY PROVISIONS
In addition to these provisions, the Swiss Code of Obligations applies.

 

14 JURISDICTION
For any disputes arising from this contract, Zurich is agreed as the exclusive jurisdiction.
